J REMINAS MINERAÇÃO LTDA is committed to complying with the privacy regulations protecting customer and general public data. 

This page is designed to provide information on how we are following data protection regulations, what information we collect while you are browsing our communication channels, and how this information is collected, used, and protected by us, in compliance with Brazilian Law No. 13,709/2018 (General Data Protection Law - "LGPD"). The use of our products and services, as well as our platforms, and other means of interaction made available, is conditioned to the acceptance of this Privacy Policy, including our employees. 

1. Sourceof Personal Data 

J REMINAS MINERAÇÃO LTDA will have access to personal data in the following circumstances: 

• When interacting with a client: when a Client provides and imputes personal data required for the provision of services and use of products provided by Colortrade. 
• Interaction with your collaborators: when your employees and collaborators of any nature use your systems and platforms to comply with the duties and obligations arising from their contractual relationship. 

2. Typesof personal data and sensitive personal data collected 

Without prejudice to the data usually collected and processed from its employees for the purposes of the legal relationship they have, J REMINAS MINERAÇÃO LTDA may also collect the following personal data: 

• Names and contact data, such as first and last name, e-mail address, postal address, telephone number, and other similar types of contact data, such as bank details; 
• DeviceInformation, such as information about your device, such as the IP address, location, or ISP; 
• Usage information and browsing history, such as information on how the User navigates within our services, their browsing history, and which elements of J REMINAS MINERAÇÃO LTDA's services are most used; 

The sensitive personal data eventually collected by J REMINAS MINERAÇÃO LTDA will have its purpose separately informed to the User, who must consent to J REMINAS MINERAÇÃO LTDA using them in a specific manner, and in case of disagreement, the data will be automatically deleted from the databases of J REMINAS MINERAÇÃO LTDA  

J REMINAS MINERAÇÃO LTDA does not collect data from minors, except with the authorization of the parents or guardians. In case data is collected without authorization, COLORTRADE will immediately delete the data collected, as per the rules of the Terms of Use and this Privacy Policy. 

3. Useofcollected personal data 

When collected, J REMINAS MINERAÇÃO LTDA will use the personal data to: 

• Provide and improve the hired services; 
• Comply with a legal or regulatory obligation; 
• Manage the relationship with the Users; 
• Setup and manage User accounts; 
• Provide technical assistance, support, and training to the User; 
• Contact Users; 
• Internal research and development purposes and to improve, test, and enhance the features and functions of J REMINAS MINERAÇÃO LTDA's services; 
• Provide the Users with marketing, publicity, advertising, including those from J REMINAS MINERAÇÃO LTDA's partner companies, as permitted by law; 
• Comply with internal and external auditing requirements, including information security obligations of J REMINAS MINERAÇÃO LTDA; 
• Send messages by e-mail to: a) confirm or cancel requests through the use of the platform; b) communicate future alterations that this policy may undergo; and c) disclose updates, alterations, inclusions of new data sources and improvements to the platform. 
• To exercise the rights of J REMINAS MINERAÇÃO LTDA , including, but not limited to, the privacy, security, networks, systems and property of J REMINAS MINERAÇÃO LTDA AND OR third parties;  
• Comply with orders issued by courts, police authorities, regulatory bodies, and other public institutions and government authorities, including but not limited to any rules in effect outside the user's country of residence 
• Theexercise of COLORTRADE's rights and to defend itself from any legal actions, as well as for the compliance with any legislation or regulation applicable to J REMINAS MINERAÇÃO LTDA or third parties with whom we work, as well as for the proper performance of contracts entered into between J REMINAS MINERAÇÃO LTDA and its users; 

4. Sharingof personal data with third parties 

The User accepts and agrees that J REMINAS MINERAÇÃO LTDA shares their personal data with the following categories of recipient: 

• Companies that provide access to or are responsible for the registration on which the user is dependent; 
• Partner companies, such as third party service providers and other companies which assist us in offering our services or which may take action on our behalf, protecting our rights, users, systems and services; 
• Third parties to whom J REMINAS MINERAÇÃO LTDA is obliged to be accountable or is authorized by law to disclose information (e.g., governmental bodies, regulatory agencies, the judiciary, and other public authorities); 
• Third parties in order to participate in the sale, merger, acquisition, restructuring, joint venture, assignment, transfer of part or all of J REMINAS MINERAÇÃO LTDA's business, in which case the User's data shall be considered an asset and transferred in an eventual negotiation; 
• Third parties who need the data to protect the rights of J REMINAS MINERAÇÃO LTDA; 
• Any natural or legal person to whom the User requests the portability of their data. 

5. Internationaltransfer of personal data  

J REMINAS MINERAÇÃO LTDA has no intention of carrying out the transfer of any personal data of the User captured outside Brazil. It assures that except for the the hypotheses below, the Users will be informed in advance by e-mail, on which occasion the User may accept or not the transfer, and in the event of disagreement, may have their access rights impeded by J REMINAS MINERAÇÃO LTDA.  

The international transfer of data described in the General Law of Data Protection (LGPD) requires the designation of guidelines to be established by the National Authority for Personal Data Protection (ANPD), whereas, when defined, J REMINAS MINERAÇÃO LTDA is committed to comply with them in full. 

6. Protectionof personal data 

J REMINAS MINERAÇÃO LTDA employs appropriate technologies and procedures to protect any personal data collected (including administrative, technical, and physical protections); in accordance with the level of risk and the service provided. The company has a legally responsible team to deal with the secure management of the data in accordance with the legal provisions, regulatory requirements, changes in technology, among other relevant factors that may influence the way the personal data is protected. 

J REMINAS MINERAÇÃO LTDA employs all reasonable efforts in the market to ensure the security of its systems and of the data collected. The company uses highly qualified and reputable internet providers and database and storage servers, as well as security certificates (SSL) and software to protect against unauthorized access to the systems, and standard methods to encrypt and anonymize the data collected. 

The present Policy represents the efforts of J REMINAS MINERAÇÃO LTDA to safeguard the User's information. However, due to the very nature of the Internet, it is not possible to guarantee that malicious third parties will not succeed in improperly accessing the information stored, for which reason, should this occur, J REMINAS MINERAÇÃO LTDA will be liable within the limits provided by Law. 

J REMINAS MINERAÇÃO LTDA , within a reasonable period of time to be defined by the National Data Protection Authority (ANPD), shall communicate to the ANPD and to the affected User the occurrence of a security incident that may cause relevant risk or damage to the affected User, mentioning, at least 

• description of the nature of the personal data affected 
• information about the data subjects involved; 
• indication of the technical and security measures used for the protection of the data, with due respect for commercial and industrial secrets; 
• risks related to the incident; 
• reasons for the delay, in case the communication was not immediate; and 
• measures that have been or will be adopted to revert or mitigate the effects of the damage. 

7. Dataprocessingand liability of Colortrade 

J REMINAS MINERAÇÃO LTDA will have its treatment responsibility as follows: 

• Whendealing with personal data provided directly by its Clients, J REMINAS MINERAÇÃO LTDA will be the Operator, and will act without interference in the form of treatment indicated by the Controller, however under the terms of the LGPD 
• J REMINAS MINERAÇÃO LTDA will be the Controller of the Personal Data of its employees, treating them based on the Execution of Contracts, on the Fulfillment of legal or regulatory obligations, and also, in specific and determined situations, on the Consent. 

J REMINAS MINERAÇÃO LTDA may adopt different legal bases for different treatments of personal data. 

8. Periodfor processing personal data 

J REMINAS MINERAÇÃO LTDA calculates the retention period for personal data according to the following criteria: 

• Period necessary to fulfill the purpose of the collection; 
• Themoment the Client/User stops using the services of J REMINAS MINERAÇÃO LTDA; 
• Themoment when there is a revocation of consent or a request for deletion of the personal data by the Data Subject; 
• Theamout time necessary to demonstrate compliance with the duties and obligations of J REMINAS MINERAÇÃO LTDA 
• Therequired period provided by law, regulations, court decisions, etc; 
• Determination of the Brazilian National Data Protection Authority; 
• Compliance with legal or regulatory obligations by the Controller 
• Perfect execution of the contract 
• Needs relating to compliance with the legal system, as well as for possible legal disputes; 
• Transfer to a third party, as long as the data treatment requirements laid down by law are respected; or 
• Exclusive useby the controller, with no access by third parties, and provided that the data are anonymized. 

  

9. UserRights 

According to the Brazilian General Law of Data Protection, the User shall have the following rights concerning the treatment of his personal data: 

• Right of Confirmation: User may confirm whether J REMINAS MINERAÇÃO LTDA is processing any of their personal data; 
• Right of Access: User may make a written request to obtain details of how their information is being used, as well as to have a copy of said information; 
• Right to Correction: User may correct or remove any data that is incomplete, inaccurate, or out of date; 
• Right to Anonymization, Blocking or Elimination: User may request the anonymization, blocking or elimination of unnecessary, excessive data or data treated in disagreement with the purposes to which their gave his/her consent, observing, for such, other rules of the legal system; 
• Right of Deletion: User may request the deletion of some data, except those for which the law authorizes its retention; 
• Right to Information: User may request information from the public and private entities with which J REMINAS MINERAÇÃO LTDA has shared the use of his/her data, as well as the consequences should they choose not to consent to the collection and processing of their personal data; 
• Right to Refuse Marketing: User may, at any time, request to cancel the receipt of advertisements and other materials by the link provided in the e-mail marketing sent.  
• Right of Portability: User may request that his personal data be transferred to themselve or to third parties, except those that have already been anonymized and deleted by J REMINAS MINERAÇÃO LTDA . 
• Right to Revocation of Consent: The User may cancel any consent previously granted to J REMINAS MINERAÇÃO LTDA to use his/her personal data. The User is aware that the cancellation shall not affect the use or sharing of the data carried out prior to the request for revocation of consent.

J REMINAS MINERAÇÃO LTDA is committed to respond to such requests as soon as possible and free of charge to the User, in a maximum period of 15 (fifteen) days, as from the receipt of the request, unless a longer period is necessary to respond due to complexity, reasons of fact or law, on which occasion the User shall be informed. 

 J REMINAS MINERAÇÃO LTDA shall immediately inform the processing agents with whom it has shared the User's data of the correction, elimination, anonymization or blocking of the data, so that they repeat the same procedure. 

The confirmation of the existence of or access to the User's personal data provided in this chapter shall be provided, electronically or expressly, in a simplified format or by means of a clear and complete statement. The statement should indicate the origin of the data, the non-existence of a record, criteria used, and purpose of the treatment, always observing the commercial and industrial secrets of J REMINAS MINERAÇÃO LTDA.  

10. Cookies

J REMINAS MINERAÇÃO LTDA and any partners may use cookies and other similar technologies to store and manage User preferences, offer targeted advertising, enable content, and collect analytical and usage data, for example. The use of cookies and other tracking technologies is a standard on websites and platform, through which information is collected about User's activities on the platform, websites, or other services. 

A cookie is a small text file, placed on a computer or other device, used to identify the User, a feature used to collect information and can perform the following functions: 

• Essential Cookies: these are essential to allow the User to navigate a platform and use its resources.  
• Performance Cookies:they collect information about how the User uses the platform of J REMINAS MINERAÇÃO LTDA and serve to improve their navigation and enhance their experience. Web Server and Platform Logs: J REMINAS MINERAÇÃO LTDA's servers automatically collect certain information to assist, administer, and protect the services offered, as well as to analyze the use and improve the User's experience. The information collected includes:

• Deviceinformation, including Unique Device Identifier (UDID), MAC address, Identifier for Advertisers (IFA) and similar identifiers assigned by us or third parties; 
• Thedevice's operating system and other technical data; 
• Thecity, state, and country from which you are accessing BRASIL RISK's platform, including for the prevention of fraud; 
• Typed information or text; 
• Linksand buttons clicked; 

Social Network Connections: some of J REMINAS MINERAÇÃO LTDA's services may include social networking features, such as Facebook "Like" buttons and widgets; "Share" buttons; and interactive mini-programs. 

J REMINAS MINERAÇÃO LTDA may allow the User to choose to use the logins of their own social networks to access some of the services offered, in which case J REMINAS MINERAÇÃO LTDA may receive and store authentication information from these services.

12. Alterations

J REMINAS MINERAÇÃO LTDA is constantly seeking to update and improve its Privacy Policy, thus the present Privacy Policy may be updated at any time, always aiming at providing a better service and protection to the users. 

In the event of alterations that affect the purpose and duration of the treatment of the User's personal data, the User will be informed through the e-mail registered in our services or through the platform itself with 30 (thirty) days' notice. In the event of disagreement with the alterations, the User may revoke the consent given, thus being unable to use the services of J REMINAS MINERAÇÃO LTDA . 

Should J REMINAS MINERAÇÃO LTDA alter its policy in the future with a view to sharing data with third parties, the same shall forward a notice 30 (thirty) days in advance to the User via e-mail of the registered user. 13. Legislationand jurisdiction 

This Policy shall be governed, interpreted, and executed in accordance with the laws of the Federative Republic of Brazil, regardless of conflicts of these laws with laws of other states or countries, and the São Paulo Court shall be competent to settle any doubt arising from this instrument, renouncing any other, however privileged it may be.
